Not for navigation
Inshore Pulse is a fishing reference and catch log. It is not a navigation system and must not be used for navigation. Depth information shown in the app is derived reference data and is not a certified nautical chart. The app does display charted markers, hazards and wrecks taken from NOAA electronic navigational charts, and it displays them for awareness only: they are not a substitute for an official chart or a chartplotter, coverage is incomplete, and buoys and markers move, go missing and are re-set. Always navigate using official NOAA charts, proper equipment, and your own observation.
By using Inshore Pulse you agree to these terms. If you do not agree, do not use the app.
What the app is
Inshore Pulse shows environmental conditions — weather, tide, moon and water temperature — on a map of eastern North Carolina waters, and lets you keep a private log of your catches. It is a reference tool to help you plan.
It does not predict whether you will catch fish, and it does not tell you whether it is safe to go out.
Safety and navigation — your responsibility
You are solely responsible for your own safety and for the safe operation of your vessel. That includes deciding whether conditions are safe, carrying required safety equipment, checking official forecasts and marine warnings, and navigating by appropriate means.
Depth contours, bottom type, structure, creek mouths, reefs and wrecks shown in the app are reference data assembled from public sources. They may be incomplete, out of date, imprecise, or wrong. Absence of a feature on the map does not mean it is absent on the water. Water depths change; charted data does not update when they do.
The app displays aids to navigation — lights, beacons, daymarks and buoys — and charted hazards such as obstructions, piles, underwater rocks and overhead cables, extracted from NOAA S-57 electronic navigational chart cells. Each feature records the chart cell, edition and update it came from. This is awareness data. It is not a certified chart, it is not updated on the schedule an official chart is, and it does not carry everything an official chart carries. What you see on the water is always right and this map is always second.
Conditions data — weather, wind, tide, water temperature — comes from third-party sources and may be delayed, interrupted, estimated, or unavailable. Some water temperature values are modeled rather than measured, and are labelled as such in the app. Never rely on this app as your only source of information before going on the water.
Your account and your content
You need an account to use the app. You are responsible for activity under your account. Your catch log is private to you; you keep ownership of what you enter, and you grant us only the permission needed to store it and show it back to you.
Do not use the app to break the law — including fishing regulations, size and creel limits, and seasons, which are your responsibility to know and follow — or to upload content you do not have the right to upload.
We may suspend or remove an account that is being used abusively or unlawfully. You can delete your account at any time from within the app; see the Privacy Policy for what deletion removes.
No warranty
The app is provided “as is” and “as available”, without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
We do not warrant that the app will be available, uninterrupted, timely, or error-free, or that any data shown in it is accurate or complete.
Limitation of liability
To the fullest extent permitted by law, Huckleberry Lane Labs LLC is not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, or goodwill, arising out of or relating to your use of the app.
To the fullest extent permitted by law, our total liability for any claim relating to the app is limited to the greater of the amount you paid us for the app in the twelve months before the claim, or twenty-five US dollars.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for personal injury or for incidental or consequential damages. Where that is the case, the limitations above apply only to the extent permitted, and nothing in these terms limits any liability that cannot lawfully be limited.
Changes
We may update these terms. If we do, the date at the top changes. Continuing to use the app after a change means you accept the updated terms.
Governing law
These terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules.
